Trademarks For The Amazon Brand Registry: How They Work Together

If you’re a retail company, you have probably heard of the Amazon Brand Registry. At first glance, it seems like it’s just a platform feature with some pretty strict requirements. In reality, it’s closely tied to trademark law. Understanding how those two systems interact can save a significant amount of time and confusion, especially as your brand grows.

What The Amazon Brand Registry Actually Is

Amazon Brand Registry wears many hats. It is Amazon’s internal system for organizing sellers, mitigation their own legal risks, verifying brand ownership. It also gives brand owners control over listings with tools for sellers tools to report infringement. To access those features, Amazon needs a reliable way to confirm that you actually own the brand you claim. This is where trademarks come in. Basically, trademark law defines who owns the brand, and Amazon Brand Registry enforces that ownership within Amazon’s platform.

Do Business Owners need trademarks for The Amazon Brand Registry?

Amazon is not in a position to independently determine who owns a brand name. Their business model would crumble if it had to also hear and resolve disputes about brand ownership and infringement. So, it relies on existing legal frameworks, primarily trademark registrations through offices like the United States Patent and Trademark Office (USPTO). Trademark memorialized at a trademark office serves as a public record of ownership, so it’s a standardized identifier that Amazon can rely on.

Sellers do in fact need a trademark application or registration to gain access. As of 2026 the Amazon Brand Registry requires a record of a trademark application, as opposed to a registration. In the past, it actually required registrations, but this became too much of a bottle neck around 2020 when the USPTO and other trademark offices received an unprecedented amount of applications. The review timeline for new applications went from 3-4 months to nearly a year. Because of this delay, Amazon opened the brand registry doors to filed applications. See our article for more information about the USPTO trademark registration timeline.

The Verification Process

Applicants and registrations to trademark offices serve as a verification mechanism through associated contact information. When you apply for Brand Registry, Amazon uses your trademark to confirm that connection. When you enroll in Brand Registry, Amazon typically identifies the trademark record that you’ve provided them, pulls the listed contact information, which is often a lawyer. They then send a verification code to that point of contact to share with you. Viola! That opens the door to the Amazon Brand Registry.

Trademarks Are Not Just for Access, They Enable Enforcement

Many sellers initially view trademarks as a requirement to “unlock” Brand Registry. Interestingly, it’s kind of the opposite. The trademark is the actual asset, and Brand Registry is simply one system that recognizes and enforces it within their system.

The value of a trademark becomes becomes apparent after enrollment in the Amazon Brand Registry. With a properly logged trademark, Brand Registry allows you to assert control over your brand presence, report infringing listings more effectively and reduce unauthorized sellers using your brand name.
